The federal Family and Medical Leave Act (“FMLA”) allows eligible employees to take unpaid leave with continued group health insurance coverage. It is generally applicable to employers with fifty (50) or more employees within a certain geographic boundary. FMLA is also applicable to employers who have voluntarily agreed to follow it. If you are unsure whether your school follows FMLA or is required to follow FMLA, consult competent legal counsel. Recently, FMLA regulations were amended to include changes to military caregiver leave for a veteran and qualifying exigency leave for parental care, among others. These changes will be effective on March 8, 2013. With the changes in the regulations, the U.S. Department of Labor updated the optional-use poster that conveys the information that covered employers are required to hang within the workplace. The new poster, or its substantial equivalent, should be displayed in your workplace no later than March 8.
